In Michigan, there are several different crimes that fall under the category of firearm-related charges. These crimes include the following:

  • Carrying a concealed weapon. In Michigan, it is illegal to carry a concealed weapon in violation of licensing regulations or if you don’t have the proper license.
  • The illegal possession of a firearm. When someone is found carrying a concealed firearm without a concealed pistol license or concealed carry permit, this is just one example of illegal possession. Other examples include possessing an illegally modified weapon, a firearm with no serial number, an illegal type of firearm, or possessing a firearm after having your right to carry a firearm taken away.
  • Felon in possession of a firearm. In Michigan, a convicted felon cannot carry a gun unless they have undergone the extremely difficult and strict process of having their gun rights restored.
  • The illegal discharge of a weapon. Even when a firearm is registered and legally in your possession, you could face charges of illegal discharge when that gun is discharged in a manner deemed unsafe or reckless.
  • Possessing a firearm on certain premises. It is illegal in Michigan to carry a firearm into certain buildings. This can include courthouses, post offices, schools, and hospitals. This regulation affects even those who hold a lawful CPL.
  • Carrying a dangerous weapon with unlawful intent. If you are found possessing a weapon with the intent to use it to commit a crime, you can be charged with various crimes relating to carrying a dangerous weapon with unlawful intent. This is a serious felony charge that can come with long prison sentences and heavy fines.
  • Felony firearm charges. When an individual carries or possesses a firearm while committing or intending to commit a felony, they can be charged with this crime in addition to the other felony offense they are accused of committing.
  • Unlawful transportation of a firearm. It is illegal in Michigan to transport or possess a firearm inside a vehicle, other than a pistol, unless that firearm is unloaded and enclosed in a case, disassembled, or carried in the trunk or other inaccessible space in your vehicle.
  • Altering or removing firearm identification. According to Section 750.230 of the Michigan Penal Code, it is considered a felony offense to purposefully alter, destroy, or remove the name of the maker, model, manufacturer’s number, or any other identifying marks from a pistol or other firearm.
  • Possession of a short-barreled rifle or shotgun. It is likewise illegal to make, possess, manufacture, or transport a rifle or shotgun that is short-barreled. This is a felony offense that can include penalties of long prison sentences, large fines, or a combination of both. Keep in mind, however, that this law does not pertain to firearms that have been lawfully created, possessed, or transferred under federal law.
  • Aiming or pointing a firearm at another individual. When an individual intentionally points or aims a firearm at another person, even without any malicious intent, this can be considered a misdemeanor offense.
  • Intentionally discharging a firearm from a vehicle. It is illegal in Michigan to fire a gun from three separate kinds of vehicles, including:
    • A motorized vehicle, such as a car
    • A snowmobile
    • An off-road vehicle

    This is a felony offense that can lead to years spent in state prison and thousands of dollars in fines.
